    Understanding Land Remediation Relief

    LRR is a tax relief scheme designed to mitigate the costs of remediating contaminated land and buildings, including removing asbestos, a common issue in older industrial and commercial properties.

    Key features of the scheme include:

    • Enhanced Tax Deduction: The scheme allows for an enhanced tax deduction of 150% of the qualifying expenditure on remediation
    • Cash Savings: For companies incurring capital expenditure, the cash tax savings can represent 37.5% of the qualifying expenditure
    • Loss-Making Companies: Companies not in a profit position can surrender the LRR tax relief for a cash credit of up to 16% of the qualifying expenditure.

    Eligibility Criteria

    To qualify for LRR, you must meet specific criteria:

    • Tax Payer: You must be a UK taxpayer
    • Trading Entity: Your company must be trading, not just holding investments
    • Contamination Presence: The property in question must have been acquired in a contaminated state, or contamination must have arisen through industrial activities.

    If all the above apply, then you should be able to benefit from the scheme.

    Eligible Expenditures

    Eligible expenditures for asbestos removal under LRR include:

    • Encapsulation or removal of asbestos cement sheeting and disposal
    • Protection of asbestos guttering and encapsulation
    • Provision of new industrial roofs to replace contaminated ones
    • Project management fees and preliminary costs associated with remediation
    • Asbestos and environmental consultancy services

    Exclusion criteria:

    • The expenditure for decontamination is subsidised, for example, by existing grant funding and, or
    • The acquisition cost of the land was discounted because of the contamination
    • The time limit for retrospective claims is up to 3 years.

    What is Derelict Land?

    Derelict land is defined as land out of productive use since 1 April 1998 and can only be bought back into productive use if buildings or structures are removed. Unlike expenditure on contaminated land, qualifying expenditure on derelict land is very specific. Qualifying expenditures include removing post-tensioned concrete heavyweight construction, building foundations and machinery bases, reinforced concrete pile caps, reinforced concrete basements or below-ground redundant services.

    Derelict Land Relief

    Derelict land relief was introduced by the Finance Act 2009 to encourage the productive use of abandoned sites. To qualify, a site must have been listed on the English National Land Use Database as derelict since 1 April 1998. For qualifying sites, generous relief is available for demolition and preparing the site for redevelopment. This would include decontamination of the site from asbestos-containing material and other contaminants.

    If the contamination was caused by the claiming company, this relief will not be allowed.

    Be aware - You can claim relief on the cost of establishing the contamination levels, removing the contamination, or containing it to remove the possibility of relevant harm. However, there is no relief if the remediation work is not carried out.

    Practical Example

    Consider a scenario where your company incurs £280,000 in qualifying asbestos removal expenses–under LRR:

    • The total tax deduction would be £420,000 (£280,000 @ 150%)
    • At a 25% tax rate, this could result in a tax cash saving of £105,000
    • Alternatively, a cash credit at 16% would amount to £67,200.
